About This Policy
This policy covers you, and the other people named in the schedule, for a trip from Australia and back: for medical emergencies overseas, for cancelling or cutting short your trip, for lost or stolen luggage and money, for accidentally injuring someone or damaging their property, and for a rental vehicle excess. You choose one of three plans, and the plan sets the limits of each benefit.
This policy, together with your schedule, the answers you gave when you bought it and any endorsements shown in the schedule, forms your contract of insurance with us. Please read them together and tell us if anything is incorrect. Where the schedule and this wording differ, the schedule applies. Words with special meanings are listed in the Definitions section.
This policy is not private health insurance and does not replace it. It cannot pay any medical expense in Australia for which a Medicare benefit is payable (see the Medicare and Health Insurance Laws provision).
Version and Document History
This document is version-controlled. The version and date shown on the cover page and in the footer of each page govern this text. The version stated in your schedule applies to your policy.
Important Information
Who issues this policy. The insurer, its Australian Financial Services Licence and its contact details are shown in the schedule. Where the insurer subscribes to the General Insurance Code of Practice, the schedule says so. This wording is not itself a Product Disclosure Statement. The insurer gives you a Product Disclosure Statement with this wording, and makes its Target Market Determination available separately.
Who this policy is for. This wording is designed for retail clients. An issuer using it must give a Product Disclosure Statement and make a Target Market Determination available, as the Corporations Act 2001 (Cth) requires. This wording is not itself a Product Disclosure Statement.
Note for issuers. Before this wording is used, the issuer must wrap it in a Product Disclosure Statement that contains the information the Corporations Act 2001 (Cth) requires for a retail travel product, and must prepare and keep current a Target Market Determination for the product.
Your duty when you buy this policy. This is a consumer insurance contract. Under the Insurance Contracts Act 1984 (Cth) you have a duty to take reasonable care not to make a misrepresentation to us before the policy is entered into, extended, varied or reinstated. Answer every question we ask, including the health questions, honestly and completely, for yourself and for everyone you name. If you do not take reasonable care, we may reduce or refuse a claim, or cancel the policy, as that Act allows. If the misrepresentation was fraudulent, we may also avoid the policy.
Terms that differ from standard cover. The Insurance Contracts Act 1984 (Cth) sets standard cover for travel insurance. This policy differs from standard cover. In particular, it does not cover, or limits cover for: - a pre-existing condition, unless we accept it (see the Pre-existing Conditions exclusion); - travel to a country or region for which DFAT advice was "do not travel" when you left for it (see the Travel Against Government Advice exclusion); - a known event, for claims under the cancellation, cutting short and delay benefits (see the Known Events exclusion); - an epidemic or pandemic (see the Epidemic or Pandemic exclusion), including, under the Essentials plan, medical expenses for an epidemic or pandemic disease; - the hazardous activities listed in the Hazardous Activities exclusion; - loss caused by you committing a criminal offence (see the Illegal Acts exclusion); - intentional self-injury, or loss to which alcohol or a drug contributes (see the Self-Injury and Intoxication exclusion); - cosmetic, elective or deferrable treatment, and treatment you travelled to obtain (see the Elective and Deferrable Treatment exclusion); - business or work you do on the trip (see the Business Travel exclusion); - pregnancy and childbirth (see the Pregnancy exclusion); - war, and nuclear, biological or chemical events (see the War exclusion and the Nuclear, Biological and Chemical exclusion); and - travellers who are older than 80 when the policy is bought, or 85 if Endorsement E15 applies (see the Who Is Covered clause).
[WP REVIEW: compare each exclusion and the age limit in this summary with the events prescribed for travel standard cover in the Insurance Contracts Regulations 2017, confirm the list is complete and clearly informs the insured under s35(2) of the Insurance Contracts Act 1984 (Cth), and confirm whether it must also be given in a separate notice.]
Cooling-off period. You may cancel this policy within 21 days of buying it by telling us in writing. If you have not started your trip and have not made a claim, we will refund the full premium, less any non-refundable government charges we cannot recover. After that, you may still cancel under the Cancellation condition.
Financial Claims Scheme. If the schedule shows the insurer is an APRA-authorised general insurer, you may be entitled to a payment under the Financial Claims Scheme if the insurer becomes insolvent. Information is available at www.fcs.gov.au.

| Insured Person | Each person named in the schedule as travelling under this policy. |

A condition we have accepted in writing and show in the schedule is not a pre-existing condition. |

| Sickness | An illness or disease that first shows itself during the trip. |

| We, Us, Our | The insurer named in the schedule. |
| You, Your | The policyholder named in the schedule, and every other insured person. |
Who and What Is Covered
Who Is Covered
The insured persons are the people named in the schedule, under one of these policy types:
- single: the policyholder;
- duo: the policyholder and one other adult; or
- family: the policyholder, their spouse or domestic partner, and their dependent children.
Each insured person must live in Australia, hold a Medicare card or a visa that allows them to return to Australia, and be no older than 80 when the policy is bought (85 if Endorsement E15 applies). Every insured person has the same plan. Unless the schedule shows otherwise, the limits in each section apply to each insured person, except personal liability, which applies to each event.
When You Are Covered
Cancellation cover starts when you buy this policy. All other cover starts when you leave your home to start the trip on the departure date shown in the schedule, and ends when you return home or on the return date shown in the schedule, whichever is earlier.
The trip must start and end in Australia (unless Endorsement E06 applies) and be no longer than the period shown in the schedule. The trip is to the destination region shown in the schedule; you are also covered while passing through other countries on the way. Travel within Australia is covered only as part of a trip overseas, unless Endorsement E05 applies.
If your return is delayed by an event this policy covers, cover continues until you can reasonably return home, for up to 90 days after the return date shown in the schedule. If you are in hospital, or a medical practitioner certifies that you are not fit to travel, cover continues until you can reasonably return home, for up to 12 months after the return date.
Medical
Medical and Evacuation Expenses
If you suffer an injury or sickness during the trip, we will pay the reasonable costs, incurred within 12 months, of the following, up to the limits for your plan:
| Benefit | Essentials | Comprehensive | Top Cover |
|---|---|---|---|
| Overseas medical, hospital and ambulance expenses | $500,000 | Unlimited | Unlimited |
| Emergency dental treatment to relieve sudden pain | $2,000 | $3,500 | $5,000 |
| Medical evacuation and repatriation to Australia, including a medical escort | Unlimited | Unlimited | Unlimited |
| Return of remains to Australia, or a funeral or cremation overseas | Unlimited | Unlimited | Unlimited |
| Economy travel and accommodation for one close relative to be with you if you are hospitalised for more than 3 days or are dangerously ill | Not included | $15,000 | $25,000 |
| Travel to rejoin your trip if you recover | Not included | $5,000 | $10,000 |
You, or someone with you, must call the 24-hour emergency assistance service before you go to hospital if you can, and as soon as practicable after a life-threatening emergency. Whether and when evacuation or repatriation is medically necessary, and how it is carried out, is decided by the treating medical practitioner together with our emergency assistance service. If they do not agree, we will arrange an opinion from an independent medical practitioner at our cost. If you refuse a repatriation that they recommend as medically necessary, we may reduce what we pay for further medical expenses by the amount that fairly represents the extent to which our interests were prejudiced by your refusal.
Under Comprehensive and Top Cover, overseas medical expenses for an epidemic or pandemic disease you contract during the trip, including COVID-19, are covered as any other sickness. Under Essentials, we do not pay medical expenses for an epidemic or pandemic disease.
Medical expenses in Australia are covered only for an insured person who is not Medicare-eligible (see the Medicare and Health Insurance Laws provision).
Cancellation and Delay
Cancellation, Cutting Short and Delay
If a reason below happens, we will pay, up to the limits for your plan:
| Benefit | Essentials | Comprehensive | Top Cover |
|---|---|---|---|
| Cancellation: non-refundable deposits and prepaid travel and accommodation you lose if you cannot start the trip | $5,000 | $15,000 | $30,000 |
| Cutting short: reasonable additional travel costs to return home early, and the unused part of prepaid costs (shares the cancellation limit) | $5,000 | $15,000 | $30,000 |
| Delay: meals and accommodation for each full 12 hours your scheduled transport is delayed, after the first 12 hours | Not included | $250 (up to $1,500) | $300 (up to $2,500) |
| Missed connection: additional travel and accommodation to reach a pre-booked event, cruise or tour you would otherwise miss | Not included | $2,000 | $3,000 |
| Accommodation after a natural disaster disrupts your trip | Not included | $3,000 | $5,000 |
The reasons are:
- you or your travel companion become seriously ill or injured, or die;
- a close relative in Australia becomes seriously ill or injured, or dies;
- a natural disaster at your destination, or an act of terrorism there within 7 days before you are due to arrive;
- your home is made uninhabitable by fire, flood or storm;
- you are called for jury service or subpoenaed as a witness;
- you are made redundant by your employer, other than voluntarily, after buying this policy;
- a travel provider becomes insolvent and you lose what you paid it, unless you booked through an agent who has also failed; or
- your scheduled transport is cancelled, delayed or diverted for a reason outside your control.
We do not pay under this section for a loss caused by:
- you changing your mind, or your work or business commitments;
- a known event, or DFAT advice that applied when you bought this policy;
- an amount that a travel provider refunds or must refund;
- a pre-existing condition, of you or of a close relative or travel companion, unless it is a condition we have accepted for an insured person;
- an epidemic or pandemic, unless Endorsement E10 applies; or
- the wedding, event or other occasion you were travelling to being cancelled, unless Endorsement E13 applies.
Luggage and Money
Luggage and Travel Documents
If your luggage and personal effects are lost, stolen or accidentally damaged during the trip, we will pay, at our option, for repair, replacement with an item of similar quality, or the value of the item at the time of loss. For an item less than 12 months old with its receipt, we pay the replacement cost; for older items we make an allowance for wear and depreciation. The limits for your plan are:
| Benefit | Essentials | Comprehensive | Top Cover |
|---|---|---|---|
| Luggage and personal effects, in total | $3,000 | $10,000 | $15,000 |
| Any one item or set, including any one item of portable electronics | $500 | $1,500 | $3,000 |
| Essential purchases if your luggage is delayed for more than 12 hours on the way out | Not included | $750 | $1,500 |
| Replacing passports, visas and travel documents | $1,000 | $3,000 | $5,000 |
A pair or set is treated as one item. If part of a pair or set is lost or damaged, we pay for that part only, unless it cannot be replaced or repaired to match.
We do not pay for:
- an item left unattended in a public place or in a vehicle, or theft from an unlocked vehicle or unlocked room;
- portable electronics, jewellery or money placed in checked luggage;
- wear and tear, gradual deterioration, scratching, or mechanical or electrical breakdown;
- sporting equipment while in use, unless Endorsement E02, E03 or E14 applies to it;
- an item confiscated or detained by customs or another government authority; or
- an amount a carrier or accommodation provider pays or must pay.
Money
If your money is stolen or lost during the trip, we will pay, up to the limits for your plan:
| Benefit | Essentials | Comprehensive | Top Cover |
|---|---|---|---|
| Money carried on you or locked in your room safe | $250 | $750 | $1,500 |
| An emergency cash advance, arranged by our emergency assistance service, after your money or cards are stolen | Not included | $500 | $1,000 |
We do not pay for money that was unattended, money not reported to the police within 24 hours of discovering the loss (subject to the Insurance Contracts Act 1984 (Cth) condition), a loss from a currency exchange or devaluation, or cryptocurrency.
Personal Liability
Personal Liability
If, during the trip, you become legally liable to pay compensation for bodily injury to another person, or loss of or damage to another person's property, caused by an accident, we will pay that compensation and the reasonable legal costs we approve, up to the limit for your plan for all claims arising from one event: Essentials $1,000,000; Comprehensive $5,000,000; Top Cover $10,000,000.
You must not admit liability, or offer or agree to pay anything, without our written consent. We may take over the defence and settlement of the claim in your name. This obligation is subject to the Insurance Contracts Act 1984 (Cth) condition.
We do not pay for liability arising from your business or profession; for injury to, or property of, an insured person, a close relative or your travel companion; arising from owning or using a motor vehicle, aircraft or motorised watercraft; assumed under a contract, unless it would have existed without the contract; from a deliberate act; or for fines, penalties or punitive, exemplary or aggravated damages.
Rental Vehicle Excess
Rental Vehicle Excess
Under Comprehensive and Top Cover, if a rental vehicle you hire for the trip is damaged or stolen while you are in charge of it, we will pay the excess or damage liability you must pay under the rental agreement, up to $5,000 (Comprehensive) or $7,500 (Top Cover) for each rental agreement, as the schedule shows. You must have taken the rental company's standard motor insurance.
We do not pay for a motorcycle or scooter, a campervan or motorhome over 4.5 tonnes or with more than 9 seats (unless Endorsement E08 applies), damage while driving off sealed roads (unless the vehicle is designed for it and the agreement allows it), driving without a valid licence for the country and vehicle, or driving while affected by alcohol or drugs.
Extras
Additional Benefits
Under Comprehensive and Top Cover, we will also pay, up to the limits for your plan:
| Benefit | Essentials | Comprehensive | Top Cover |
|---|---|---|---|
| Accidental death within 12 months of an injury during the trip, to the insured person's estate | Not included | $25,000 | $50,000 |
| Permanent loss of sight in an eye, or of the use of a hand or foot, or permanent total disablement, within 12 months of an injury during the trip | Not included | $25,000 | $50,000 |
| Extra boarding for your pet in Australia if your return is delayed by an event this policy covers | Not included | $500 | $1,000 |
| Cruise: a missed port of call because of your sickness, and each full day of cabin confinement on medical advice ($100 a day) | Not included | $1,500 | $3,000 |
Only one of the accidental death and permanent disablement benefits is payable for any one injury. For a dependent child, the accidental death benefit is limited to $10,000.
How We Pay
Limits and Excess
The most we will pay for each benefit is the limit for your plan, as each section shows. A limit in a table is for each insured person unless it says otherwise. The total paid under cancellation and cutting short together is no more than the cancellation limit.
We deduct the excess shown in the schedule from each claim. Only one excess applies to all claims arising from one event, whichever sections they fall under. No excess applies to the emergency evacuation and repatriation benefits or the additional benefits for accidental death and permanent disablement.
Medicare and Health Insurance Laws
The Health Insurance Act 1973 (Cth), the National Health Act 1953 (Cth) and the Private Health Insurance Act 2007 (Cth) do not allow us to pay:
- any medical expense for which a Medicare benefit is payable, or any gap between the Medicare benefit and the fee charged; or
- any amount that would make this policy health insurance business under those Acts.
We will not pay any benefit, or part of a benefit, to the extent that paying it would breach those Acts. Emergency transport home from overseas, and the other benefits of this policy, are not affected.
Other Insurance
If a loss covered by this policy is also covered by another insurance policy, we will not refuse or reduce our payment because of that other insurance. We may seek contribution from the other insurer as the law allows. This does not apply where the schedule or an endorsement states that this policy is excess of a specified underlying policy, in which case this policy pays only after the limit of that specified policy is exhausted.
You must tell us about any other insurance that may cover the loss when you make a claim.
Recovery
After we pay a claim, we may recover the amount from anyone responsible for it, in your name. You must give us reasonable help to do this.
Who We Pay
We pay the accidental death benefit to the insured person's estate. We pay other benefits to the insured person who incurred the cost, or directly to the provider of the service. Payment discharges our liability for that amount. All amounts are paid in Australian dollars, at the exchange rate on the date the cost was incurred.
What Is Not Covered
These exclusions apply to every section, in addition to the exclusions in each section.
Pre-existing Conditions
We do not pay any claim arising from a pre-existing condition of an insured person unless we have accepted it in writing, or Endorsement E01 applies to it.
This exclusion is subject to s.47 of the Insurance Contracts Act 1984 (Cth): we will not rely on it for a condition the insured person was not aware of, and that a reasonable person in their circumstances could not have been expected to be aware of, when the policy was bought.
Travel Against Government Advice
We do not pay any claim arising in a country or region for which DFAT advice was "do not travel" when you left for it.
War
We do not pay any claim caused by war, invasion, act of a foreign enemy, hostilities (whether war is declared or not), civil war, rebellion, revolution or insurrection. This exclusion does not apply to an act of terrorism you took no part in, or to an insured person who is already in a country when war unexpectedly breaks out there, for 14 days after it breaks out.
Nuclear, Biological and Chemical
We do not pay any claim caused by ionising radiation or contamination by radioactivity from any nuclear fuel, nuclear waste or nuclear weapon, or by the use of a biological or chemical weapon.
Epidemic or Pandemic
We do not pay any claim under the cancellation and delay section caused by an epidemic or pandemic, or by government action taken because of one, unless Endorsement E10 applies.
This exclusion does not apply to the medical section under Comprehensive and Top Cover. Under Essentials, we do not pay medical expenses for an epidemic or pandemic disease. The Medical and Evacuation Expenses clause sets out the position for each plan.
[WP REVIEW: confirm that excluding medical expenses for an epidemic or pandemic disease under Essentials only, and covering them under Comprehensive and Top Cover, is acceptable for a retail travel product and is clearly disclosed.]
Known Events
We do not pay any claim under the Cancellation, Cutting Short and Delay clause that is caused by a known event. This exclusion does not apply to any other section of this policy.
Self-Injury and Intoxication
We do not pay any claim caused by an insured person's intentional self-injury, or by their being under the influence of alcohol or a drug to the extent it contributed to the loss, unless the drug was taken as prescribed by a medical practitioner.
[WP REVIEW: confirm the self-injury exclusion as drafted is consistent with the Disability Discrimination Act 1992 (Cth) for injury resulting from a mental illness.]
Illegal Acts
We do not pay any claim to the extent that it was caused or contributed to by an insured person committing a criminal offence.
Hazardous Activities
We do not pay any claim caused by an insured person taking part in professional sport, motor racing, mountaineering or rock climbing using ropes, skydiving, hang-gliding, paragliding, base jumping, bungee jumping, scuba diving deeper than 30 metres or without a qualified instructor or certification, snow sports (unless Endorsement E02 applies), or flying other than as a fare-paying passenger, unless Endorsement E03 applies.
Pregnancy
We do not pay medical expenses for normal pregnancy or childbirth, or for any pregnancy-related condition after the 26th week of pregnancy (36th week if Endorsement E09 applies), unless the condition is a complication a medical practitioner certifies as unforeseen.
[WP REVIEW: confirm the 26-week threshold is consistent with the Sex Discrimination Act 1984 (Cth) and its exemption for insurance based on actuarial or statistical data.]
Elective and Deferrable Treatment
We do not pay for treatment you travelled to obtain, cosmetic or elective treatment, or treatment that a medical practitioner certifies could reasonably be delayed until you return home.
Business Travel
We do not pay any claim arising from business or work you do on the trip, including manual work of any kind.
This exclusion does not apply to attending meetings, conferences and trade shows if Endorsement E07 applies, or to the casual work that Endorsement E06 allows. Endorsement E07 does not write back manual work.
Your Obligations
Emergencies
In a medical emergency, you or someone with you must contact the 24-hour emergency assistance service on the number shown in the schedule as soon as practicable. In a life-threatening emergency, call local emergency services first. These obligations are subject to the Insurance Contracts Act 1984 (Cth) condition.
Making a Claim
You must tell us as soon as reasonably practicable about any event that may lead to a claim, and give us the information and documents we reasonably need to assess it: original receipts, medical reports, a carrier's report of lost or damaged luggage, written confirmation of a delay, and for theft or loss of property or money, a police report obtained within 24 hours of discovering it or as soon as practicable after that.
You must take reasonable care of your belongings and take reasonable steps to prevent or reduce loss. These obligations are subject to the Insurance Contracts Act 1984 (Cth) condition.
General Conditions
Insurance Contracts Act 1984 (Cth)
Nothing in this policy excludes, restricts or modifies the operation of the Insurance Contracts Act 1984 (Cth). Where this policy is inconsistent with the Act, the Act prevails.
If this policy would otherwise let us refuse to pay a claim, in whole or in part, because of something you did or did not do after this policy was entered into, section 54 of the Act applies. We may not refuse to pay the claim only because of that act or omission. Our liability is reduced by the amount that fairly represents the extent to which our interests were prejudiced. Where the act or omission could reasonably be regarded as capable of causing or contributing to the loss, we may refuse to pay only the part of the claim that the act or omission caused or contributed to. We may not refuse any part that you prove the act or omission did not cause. This applies to every condition, exclusion, limit and obligation in this policy, not only to the claims conditions.
Cancellation
You may cancel this policy at any time by telling us. We refund the premium for the unexpired period of insurance on a pro-rata basis, less any non-refundable government charges. If you cancel before the trip starts, the unexpired period is the whole trip. After the trip starts, it is the part of the trip, up to the return date shown in the schedule, that has not yet happened. If you cancel within the cooling-off period, the refund is as the Important Information section states.
We may cancel this policy only as the Insurance Contracts Act 1984 (Cth) allows, by giving you written notice as that Act requires. We refund the premium for the unexpired period on a pro-rata basis.
Fraud
If a claim is made fraudulently, we may refuse to pay it, as s.56 of the Insurance Contracts Act 1984 (Cth) allows.
Sanctions
We do not provide cover, pay any claim or provide any benefit under this policy to the extent that doing so would expose us to any sanction, prohibition or restriction under: - the Autonomous Sanctions Act 2011 (Cth), the Charter of the United Nations Act 1945 (Cth), or regulations made under either Act; or - the trade or economic sanctions laws of the United Kingdom, the United States of America or the European Union, to the extent they apply to us.
[WP REVIEW: confirm that naming the UK, US and EU regimes is appropriate for Australian capacity; this is a deliberate library-wide scope choice.]
GST
The premium includes GST where it applies, under A New Tax System (Goods and Services Tax) Act 1999 (Cth). Insurance for travel outside Australia is GST-free to the extent the law allows. The accidental death and permanent disablement benefits are fixed amounts and are not adjusted for GST.
Privacy
We collect, use and disclose personal information about you and the other insured persons, including health information, to assess your application, administer this policy, provide emergency assistance and manage claims, in accordance with the Privacy Act 1988 (Cth) and our privacy policy. Our privacy policy explains how to access and correct information and how to complain about a privacy matter.
Disputes and Complaints
If you are unhappy with our service or a decision, contact us at the details in the schedule. We will acknowledge your complaint within one business day and give you our decision within 30 calendar days.
If you are not satisfied with our response, or we have not responded within 30 calendar days, you may take your complaint to the Australian Financial Complaints Authority (AFCA), a free and independent dispute resolution service: www.afca.org.au, 1800 931 678, info@afca.org.au.
Governing Law
This policy is governed by the law of the Australian state or territory where the policyholder lived when the policy was bought, as shown in the schedule.
Jurisdiction
You and we submit to the jurisdiction of the courts of the state or territory whose law governs this policy, and of any court that may hear appeals from them.
Headings and References
Headings are for convenience only. A reference to legislation includes any legislation that amends or replaces it. A reference to a clause by its heading is a reference to that clause as it appears in this wording. A reference to an endorsement by its code is a reference to that endorsement in the Endorsement Library, and it applies only if the schedule shows it.
How to Make a Claim
- In an emergency, call the 24-hour emergency assistance number shown in the schedule.
- Otherwise, contact us at the details shown in the schedule, or lodge a claim online, as soon as reasonably practicable (see the Making a Claim obligation).
- Send us the evidence for your claim: receipts, medical reports, carrier and police reports, and confirmation of any delay or cancellation.
- Tell us about any other insurance, carrier compensation or card scheme that may cover the loss.
- We will acknowledge your claim and keep you informed, as the General Insurance Code of Practice requires where the insurer subscribes to it.
Endorsement Library
An endorsement applies only if its code is shown in the schedule. Each endorsement changes this policy only as it states, and is read together with the variables shown for it in the schedule. Where an endorsement and the rest of this policy conflict, the endorsement applies to the extent of the conflict. If a variable an endorsement needs is not shown in the schedule, the default stated in the endorsement applies; if it has no default, the endorsement does not apply until we show the variable in the schedule.
