Risk, Safety and Claims Consultants Professional Indemnity Insurance — Endorsement

The Risk, Safety and Claims Consultants Professional Indemnity Insurance terms, in the form of an endorsement to the base Professional Indemnity Insurance wording.

Application

This endorsement attaches to and forms part of the Meridian Professional Indemnity Insurance wording, version 1.5.0-DRAFT (document reference 2026/PI/0001), referred to here as the base wording. It changes the base wording only as set out below. All other terms, conditions, exclusions and limits of the base wording continue to apply.

Words defined in the base wording have the same meaning in this endorsement. Where this endorsement and the base wording conflict, this endorsement applies to the extent of the conflict.

The same terms are published as a single integrated wording, Risk, Safety and Claims Consultants Professional Indemnity Insurance, version 1.1.0-DRAFT. Both documents are generated from the same source and have the same effect.

Replaced: Professional services

The definition of Professional services in the base wording is deleted and replaced with the following.

Professional services

The following services provided to a third party for a fee:

(a) work health and safety consulting, including psychosocial hazard assessment;

(b) risk management consulting;

(c) fire safety consulting, other than fire safety engineering and the design or certification of fire safety systems;

(d) loss assessing and loss adjusting;

(e) claims management services, other than deciding or settling insurance claims, unless that service is shown in the schedule;

(f) workplace investigations;

(g) investigation and surveillance services, provided by a person who holds the licence the law requires;

(h) non-clinical injury management and return-to-work coordination;

(i) training in any of these services; and

(j) any other service shown in the schedule as a professional service.

The Financial Services exclusion does not apply to the services in (d) and (e), other than deciding or settling insurance claims, unless the work involves financial product advice, dealing in a financial product or a credit activity.

[WP REVIEW: confirm whether loss assessing and loss adjusting are financial services (claims handling and settling) that need an Australian financial services licence.]

Added: Workplace Investigation Reports

The following extension is added to the base wording, after the Subcontractors and Outsourcers extension.

Workplace Investigation Reports

Despite the limit to unintentional defamation in the Claims Against You clause, the cover for defamation includes a claim by a person who was the subject of, or a witness in, a workplace investigation you conducted, arising from statements in a report you gave to your client, whether or not you intended to publish the report to your client, unless a Final adjudication establishes that you published the statements with malice.

Added: Clinical Services

The following exclusion is added to the base wording, after the Bodily Injury and Property Damage exclusion.

Clinical Services

Arising from the diagnosis, treatment or clinical assessment of any person by a medical practitioner, nurse, psychologist or other registered health practitioner, including fitness-for-work medical assessments.

This exposure is designed to be covered under an allied health or medical indemnity policy.

Added: Fire Safety System Design and Certification

The following exclusion is added to the base wording, after the Products exclusion.

Fire Safety System Design and Certification

Arising from the design, specification, installation, commissioning or certification of a fire safety system, or the preparation of a fire safety performance solution under the National Construction Code.

The definition of Professional services already leaves this work out. This exclusion applies even where the schedule describes a fire safety service in general terms. It does not apply to work that the schedule names specifically as a professional service.

Risk, Safety and Claims Endorsements

The following endorsements apply to this policy only when the schedule shows that they apply.

An endorsement does not apply to the extent that a law requiring you to hold this insurance does not permit the cover it removes to be excluded or limited.

Claims Handling Authorisation

Deciding and settling insurance claims on behalf of an insurer is a professional service under this policy while you are authorised to provide it under the Australian financial services licence, or as an authorised representative of the licensee, shown in the schedule.

For a claim arising from that service, the Financial Services exclusion does not apply.

[WP REVIEW: confirm whether any compensation arrangement requirement under ASIC RG 126 applies to an insured who decides or settles claims under an Australian financial services licence, and whether this cover meets it.]

Wording note — platform rule (not part of the policy)

Questions

  • Do you decide or settle insurance claims on behalf of insurers? qs.pi.rs.claims_decisions
  • If so, do you hold an AFS licence authorising claims handling and settling, or act as an authorised representative of a licensee? Give the number. qs.pi.rs.afsl_or_ar

Default rules (the first rule that matches applies; agencies may set their own actions and thresholds)

  • When qs.pi.rs.claims_decisions = yes and qs.pi.rs.afsl_or_ar = yes: Apply automatically
  • When qs.pi.rs.claims_decisions = yes and qs.pi.rs.afsl_or_ar = no: Refer to the underwriter, with the endorsement pre-selected

Reason shown on the quote and schedule: Applies because you decide insurance claims on behalf of insurers.

Surveillance Exclusion

We do not cover any claim, loss or liability arising from covert surveillance of a person, including any claim for trespass, invasion of privacy or breach of a surveillance devices law.

Wording note — platform rule (not part of the policy)

Reason shown on the quote and schedule: Applies because {qs.pi.rs.surveillance_pct}% of your fees come from surveillance.

Psychosocial Hazards Sub-limit

For all claims arising from the assessment of, or advice on, psychosocial hazards, the most we will pay in total, including defence costs, is the sub-limit shown in the schedule for this endorsement. The sub-limit is part of, and not in addition to, the limit of liability.

Reason shown on the quote and schedule: Applies because {qs.pi.rs.psychosocial_pct}% of your fees come from psychosocial hazard work.

Fire Safety Engineering Exclusion

We do not cover any claim, loss or liability arising from fire safety engineering advice, including fire modelling, egress analysis and the assessment of fire safety performance.

This endorsement applies even where the schedule describes a fire safety service in general terms. It does not apply to advice that the schedule names specifically as a professional service.

Wording note — platform rule (not part of the policy)

Reason shown on the quote and schedule: Applies because you provide fire safety engineering advice.

Expert Witness

Preparing expert reports for legal proceedings and giving expert evidence are professional services under this policy.

We also pay, under the Inquiry Costs extension, your defence costs in responding to a complaint to a professional body arising from your expert evidence.

Wording note — platform rule (not part of the policy)

Questions

  • Do you prepare expert reports for legal proceedings or give expert evidence? qs.pi.rs.expert_witness

Default rules (the first rule that matches applies; agencies may set their own actions and thresholds)

  • When qs.pi.rs.expert_witness = yes: Offer as a priced option

Reason shown on the quote and schedule: Offered because you give expert evidence.
